The owner of a large property in Orange County retained Z&S to defend a lawsuit brought by neighbors claiming a breach of a restrictive covenant in their deeds. On behalf of the property owner, Partner Daniel Richmond and Counsel Lee Lefkowitz made a motion to dismiss, arguing that the neighbor’s action was mooted and superseded by the municipality’s authority, and the court agreed. The Court granted Z&S’s pre-answer, pre-discovery motion to dismiss just four months after the case was initiated. The case is Ronen v. Kestenbaum, No. EF008144-2021 (Sup. Ct. Orange Cnty.)
