Daniel Richmond and Lee Lefkowitz defended property owners in a Rockland County Supreme Court lawsuit brought by a neighboring landowner alleging nuisance and trespass. The case involved a lengthy discovery process including document productions, interrogatories, and depositions. During depositions, Z&S deposed the Plaintiff and secured an admission that the Plaintiff lacked adequate knowledge to support his claims of nuisance, or that there was any trespass. Z&S then obtained third-party testimony and documents supporting its defenses, and ultimately made a motion for summary judgment. Justice Zugibe adopted Z&S’s arguments and dismissed each of Plaintiff’s causes of action, denying the Plaintiff an opportunity to bring the case to trial.
