Dan successfully argued that a challenge to a 36-unit residential project in the Village of Spring Valley was barred by the doctrine of laches. The Court not only denied the petitioner’s motion for a preliminary injunction to enjoin construction, but also granted Zarin & Steinmetz’s motion to dismiss the litigation. The Court concurred that there was no excuse for petitioner’s delay in commencing the proceeding, where construction activities had taken place within view of petitioner’s property.
